South African Citizenship Restored in Landmark Constitutional Court RulingÂ
In a historic judgment delivered on 6 May 2025, the South African Constitutional Court has restored the citizenship of thousands of individuals who had previously lost their status upon acquiring a second nationality. What the Constitutional Court Decided
The court declared section 6(1)(a) of the South African Citizenship Act unconstitutional. This section previously stated that South Africans who voluntarily acquired another nationality without first obtaining permission from the Minister of Home Affairs would automatically lose their South African citizenship.
The court found that this automatic loss of citizenship was an unjustifiable violation of the constitutional right to citizenship under section 20 of the Constitution. Importantly, the ruling is retroactive to the date of the Act’s original enactment on 6 October 1995.

If You Previously Lost Your SA Citizenship
If you acquired another nationality without ministerial permission and were told your South African citizenship was forfeited, this ruling restores it automatically. Legally, you are now considered never to have lost it. The Department of Home Affairs has confirmed that it is developing a digital portal, to allow individuals to confirm their reinstated status conveniently from anywhere in the world.
