How Does One Get Banned from South Africa?
South Africa’s immigration legislation provides for serious consequences when a foreign national overstays their visa. In terms of Section 30 of the Immigration Act 13 of 2002, the Director General of Home Affairs may declare such a person undesirable.
The Act lists several categories of undesirable persons, which include individuals who have overstayed their visa. Once a person has been declared undesirable, they face a ban from re-entering South Africa for a prescribed period.
How Long Does an Undesirable Ban Last?
The duration of the ban is directly linked to the length of the overstay.
If you overstay for up to 30 days, you will be banned for 12 months. An overstay that exceeds 30 days results in a 5-year ban. Where a second overstay occurs within a 24-month period, the ban is 2 years.
These bans do not expire automatically. A person remains undesirable until an application for the upliftment of the ban has been successfully processed and approved by the Director General.
How to Apply for an Undesirable Upliftment
Individuals who have been banned may apply for what is commonly referred to as an undesirable upliftment. This requires a carefully drafted and detailed appeal submitted to the Director General of Home Affairs.
The appeal must provide a clear explanation of the reasons that led to the visa overstay and must be supported by persuasive motivation that demonstrates why the ban should be lifted. It is crucial to ensure that the appeal is professionally presented to maximise the chances of success.
